1. Scope of the General Ticket Terms and Conditions

1.1 Scope of application: These General Ticket Terms and Conditions (hereinafter: "Terms and Conditions") govern the purchase and/or use of match day tickets and/or other admission tickets (hereinafter: "Ticket(s)") for events of Borussia Dortmund GmbH & Co. KGaA, Rheinlanddamm 207-209, 44137 Dortmund, Germany (hereinafter: "BVB" or the "Organiser") of the Organiser or from third parties authorised by the Organiser at the respective venue, particularly at SIGNAL IDUNA PARK or the Rote Erde stadium, Strobelallee 50, 44139 Dortmund, Germany (respectively the "Stadium") as well as to entry to and presence in the Stadium. This also applies if the events take place in a BVB venue other than the Stadium.

1.2 Away match tickets: These Terms and Conditions also govern the legal relationship established by virtue of the purchase and/or use of Tickets for away match days of BVB ("Away Match Tickets") if the Away Match Tickets are purchased from BVB or authorised sales or ticket offices. Further terms and conditions may apply at the latest upon entry to the stadium for away matches (such as the general terms and conditions or stadium rules of the home club). Should these Terms and Conditions conflict with any terms or conditions of the home club, these Terms and Conditions take precedence with respect to the relationship between the customer and BVB. These Terms and Conditions do not extend to legal relationships that entitle customers to submit offers to purchase tickets for matches organised by the respective away club (e.g. allocation of promo codes).

1.3 Away fan tickets: These Terms and Conditions also apply to the legal relationship established by virtue of the purchase of tickets through the visiting club and/or the use of these tickets to enter the Stadium for a match featuring the visiting club in the Stadium ("Away Fan Tickets"). Should these Terms and Conditions conflict with any terms or conditions of the respective visiting club cited by said club upon the sale of the Tickets, such as the general terms and conditions of the visiting club, these Terms and Conditions take precedence with respect to the relationship between the customer and BVB.

1.4 Public transport: With regard to any claim to transportation using modes of transport operated by the public transport authorities in North Rhine-Westphalia (VRR, VRS, AVV and WT [NWL]), a contract of carriage is established exclusively between the purchaser of the Ticket and the transport company the purchaser uses, on behalf of which the Organiser collects the share of the price of a Ticket attributable to transport costs. Reference is made to any additional terms and conditions of carriage of the transport company; in particular, in the case of print@home tickets or, if applicable, mobile tickets, a separate public transport ticket must be obtained by the spectator free of charge via the DSW21 portal. The public transport operator remains responsible for providing the public transport service.

2. Ordering Tickets, formation of contract and service

2.1 Purchasing channels: Tickets for BVB events are only available from BVB or authorised sales or ticket offices (including the visiting club) or via BVB's official secondary market platform (https://www.ticket-onlineshop.com/ols/bvb/) ("Secondary Market Platform"). Enquiries as to whether a sales or ticket office is authorised by BVB can be made using the contact details in clause 14 ("Contact Address"). Should other terms and conditions apply to the purchase of Tickets from authorised sales or ticket offices in addition to these Terms and Conditions, these Terms and Conditions take precedence with respect to the relationship between the customer and BVB.

2.2 Online orders: It may be necessary to issue login details for the ordering of Tickets online. The customer is responsible for ensuring that no third parties obtain the login details without authorisation. The customer is liable for all misuse by third parties in this context, unless the customer is not responsible for the misuse. In the case of ordering a Ticket online, the customer submits a binding offer for the conclusion of a contract with BVB by initiating the Ticket order on the BVB website using the online command intended for this purpose. Should BVB provide confirmation to the customer regarding the receipt of the contractual offer online ("Order Confirmation"), this Order Confirmation does not yet represent the acceptance of the offer, rather is conditional on the availability of the ordered Tickets and theconsideration of special circumstances (e.g. safety aspects). In the case of the online ordering process, the contract between BVB and the customer on the basis of these Terms and Conditions is only formed upon the provision (incl. electronically, in the case of print@home tickets or, if applicable, mobile tickets or, if applicable, provision via the app) or, if applicable, the holding of the Tickets for collection (clause 5).

2.3 Other orders: In the case of orders submitted via other BVB sales channels, the contract is formed on the basis of these Terms and Conditions at the time the Tickets are provided (incl. electronically, in the case of print@home tickets or, if applicable, mobile tickets or, if applicable, provision via the app) or, if applicable, held for collection (clause 5).

2.4 Special terms and purchases by bots: BVB reserves the right to limit the maximum number of Tickets available for sale as part of an event and to an individual customer at its own discretion and to grant or refuse discounts on Tickets and/or preferential conditions. Different terms and conditions may apply to authorised booking offices. Irrespective of the sales channels referred to in clause 2.1, the purchase of any Ticket using automated systems designed to circumvent restrictions on the number of Tickets able to be purchased by a single person or other terms and conditions applying to the sale of Tickets (using what are known as bots) is not permitted and gives BVB the right to not accept or rather cancel the order and impose a contractual penalty in accordance with clause 11.

2.5 Right to attend: BVB, as the issuer of the Ticket, does not wish to grant entry to events in the Stadium to all, rather only to those Ticket holders who have purchased Tickets as a customer from BVB or an authorised sales or ticket office, through the Secondary Market Platform or within the scope of an authorised transfer pursuant to clause 8.3 and, if applicable, meet any additional entry requirements (e.g. those set out in clause 9.4). BVB therefore only grants a right to attend to those persons who are identifiable through the personalisation printed on or stored in the Ticket (e.g. printed name, barcode or QR code, shopping basket number) and/or to those persons who have purchased their Tickets on the secondary market in a permissible manner pursuant to clause 8.3 and, if applicable, meet any additional entry requirements (e.g. those set out in clause 9.4) ("Right to Attend"). Customers must carry a suitable form of official identification (e.g. an identification card or a passport) and present this identification at the request of BVB and/or security personnel. Upon entry to events in the Stadium, customers and Ticket holders are obliged to disclose, at the request of BVB, the channel they used to purchase the Tickets and at what price they purchased the Tickets; this may also include naming the Ticket seller. Tickets offered on sales platforms not authorised by BVB or otherwise offered for sale by third parties do not grant a Right to Attend pursuant to clause 2.5 and may result in legal action being taken pursuant to clauses 8.5 and 9.3. BVB fulfils its obligations regarding the Right to Attend of the customer or the respective Ticket holder by granting one-time entry to the event(s). BVB is also released from this obligation if the customer and Ticket holder have not acquired a valid Right to Attend in accordance with this clause.

3. Discounted Tickets

3.1 Discount entitlement: BVB may grant discounts to certain groups of people; reference is made to the current price list in this regard. Double discounts are not offered. The discount entitlement must apply on the date of the event for which the Ticket is purchased.

3.2 Proof of discount entitlement: Official proof of the discount entitlement is to be presented when purchasing the Ticket and is to also be carried when entering the Stadium and presented to security personnel on request. If the proof of discount entitlement cannot be provided or is not valid, customers may be denied entry to the Stadium with no right to compensation. Any violations with regard to discount entitlements may lead to ejection from the Stadium as well as a criminal complaint.

3.3 Kids Tickets: Kids Tickets can only be purchased together with at least one adult Ticket. Children in possession of a kids Ticket are only granted access to the Stadium if accompanied by an adult with a valid Ticket of their own who is responsible for their supervision.

3.4 Transfer and upgrading: The provisions in clause 8 apply to the transfer of discounted Tickets, together with the additional condition that transfer is only possible if the new Ticket holder also possesses and provides evidence of the respective discount entitlement according to clause 3.2, unless the new Ticket holder pays the difference in price between the discounted Ticket and a regular match Ticket on the respective match day prior to entering the Stadium ("Upgrade") Upgrades can also be purchased on the BVB website (www.bvb.de) insofar as BVB offers this service at its own discretion. BVB may charge a service fee and, if applicable, shipping fee pursuant to the price list for an Upgrade. Discounted match Tickets can only be purchased if

the discount entitlement pursuant to clause 3.1 is presented upon the purchase of the Ticket and upon entering the Stadium.

3.5 Special Tickets: BVB may, at its own discretion, issue Tickets free of charge or fees ("Special Tickets"). Special Tickets are only issued for a specific purpose, which is stated by BVB as the issuer, and therefore special provisions may apply in this respect in deviation from the provisions applying to other Tickets under these Terms and Conditions.

4. Payment

4.1 Prices and methods of payment: The Ticket price is determined in accordance with the price list, while Ticket categories are based on the current Stadium seating plan; the terms and conditions of the home club apply accordingly to Away Match Tickets. Ticket orders are only processed in return for advance payment using accepted methods of payments. Customers may pay by credit card (VISA, MasterCard, American Express), by SEPA direct debit or using PayPal. VISA and MasterCard payments are processed by CTS EVENTIM Nederland B.V., Postbus 3096, 2130 KB Hoofddorp, Netherlands. 

In the case of Tickets sent by post, BVB may also charge the purchaser for postage and/or an appropriate service fee for services in the purchaser's interests in addition to the Ticket price. The purchaser is made aware of these fees within the scope of the ordering process pursuant to clause 2.

If, as an exception, an order is accepted for subsequent payment on account, the purchaser undertakes to settle the invoice amount within 14 days of receiving the invoice. If the purchaser fails to settle the amount on time, the purchaser will be in default of payment automatically, without needing to be served with a specific demand notice. BVB also reserves the right to utilise payments to settle the oldest outstanding invoice amount, plus accrued default interest and costs, in the following order of priority: costs, interests, principal claim.

4.2 Cancellation: Should payment not be successfully taken for reasons attributable to the customer (e.g. insufficient funds, chargeback), BVB is entitled to cancel the order without compensation or rather block the corresponding Tickets from being used. BVB also has the right to cancel Ticket requests or deny entry to the Stadium if incomplete or incorrect details, including names, addresses, telephone numbers and e-mail addresses, are provided. The corresponding Tickets become invalid when blocked. Any additional costs incurred are to be reimbursed by the customer. BVB reserves the right to assert further claims for compensation.

4.3 SEPA direct debits: If the customer sets up a direct debit with BVB, the direct debit is usually not charged until after the invoice is issued, with the customer being notified at least one working day in advance. The customer warrants that sufficient funds are available to cover the direct debit. Costs incurred due to the non-payment or chargeback of direct debits are borne by the customer provided the non-payment or chargeback was not caused by BVB.

5. Shipping and holding for collection

5.1 Postage: Tickets in paper form are shipped at the customer's expense. BVB is responsible for choosing the shipping company and providing said company with the customer's details for the performance of the contract in accordance with Article 6(1) sentence 1(b) of the EU General Data Protection Regulation ("GDPR"). BVB bears the risk of loss or damage during shipping. Tickets are usually delivered to customers within seven (7) working days of the Order Confirmation (see clause 2.2). If the Tickets have not been received by this time, BVB must be notified without undue delay of the loss during shipping using the Contact Address. Tickets lost during shipping will be re-issued by BVB in accordance with the terms of clause 6.3.

5.2 Electronic Tickets: In the case of electronic Tickets (e.g. print@home or mobile tickets), Tickets are provided to customers electronically (e.g. via e-mail) in the form a QR code or barcode as well as in PDF format, or via a mobile app. No shipping fees are charged for the provision of an electronic Ticket. The QR code or barcode to enter the Stadium site is to be made permanently available on the mobile device (e.g. smartphone) or printed out legibly in A4 form and to be carried at the event. Barcodes or print-outs that are illegible through no fault of BVB do not grant the holder entry to the Stadium site. The legal basis for the associated processing of personal data is Article 6(1) sentence 1(f) GDPR.

5.3 Holding for collection: If, in the event of Tickets ordered at short notice, BVB deems that it is no longer guaranteed that the Tickets will be received in time, it is possible on a case-by-case basis at BVB's discretion to agree for the Tickets to be held at the Stadium service centre [currently the outside counter at the BVB FanWelt] for collection. Tickets may only be collected by the customer or a third party authorised in writing by the customer able to identify themselves by means of an official form of identification (identification card, passport, etc.). BVB may charge an appropriate service fee for the holding of Tickets for collection. The risk of loss of or damage to Tickets prior to collection is borne by the customer, except in the case of gross negligence or wilful conduct on the part of BVB or a third party acting on behalf of BVB.

6. Complaints, defects, loss

6.1 Complaints: The customer is obliged to check both the Order Confirmation and the Ticket without undue delay after receipt to ensure that the details are correct, particularly with regard to the number, price, date, event and event location. Complaints regarding Tickets and/or Ticket orders that are visibly incorrect must be submitted promptly, in other words without undue delay, usually within five (5) working days of receipt and at least seven (7) working days prior to the respective event in text form (e-mail is sufficient) or by post addressed to the Contact Address. In the case of Tickets and/or Ticket orders submitted within the seven (7) working days prior to the respective event, other orders pursuant to clause 2.3 in which the Ticket is provided and/or in the event of Tickets held for collection pursuant to clause 5.3, the complaint must be submitted without undue delay and is otherwise subject to the above terms. Tickets are defective within the meaning of clause 6.1 if they feature unacceptable deviations from the order regarding number, price, date, event or event location, an incorrect printed image, incorrect key details such as the event or seat number in the case of paper Tickets and/or visible damage to or destruction of the Ticket. Compliance with the complaint period is determined by the date recorded on the receipt stamp or in the e-mail transmission log. In the event of a legitimate complaint submitted in due time regarding electronic Tickets, BVB will block the original Tickets upon presentation of evidence of the error and confirmation of the customer's identity (e.g. submission of a screenshot together with the order number) and issue a new electronic Ticket without the error free of charge. The provisions regarding complaints expressly do not apply to Tickets lost pursuant to clause 6.3 or for the sending of Tickets that have not been ordered as well as in cases in which the reason for the complaint is proven to be the fault of BVB.

6.2 Defect: If a Ticket has a technical defect or in the event of difficulties in passing through the electronic barriers, BVB will block the original Ticket and issue a new Ticket, or authorise the old Ticket, upon confirmation of the customer's identity. This explicitly does not apply to technical defects that have clearly been caused by the customer (e.g. damage to the personalisation printed on or stored in the Ticket (see clause 9.3(d), defects affecting the mobile device (e.g. smartphone), illegible print-outs, etc.) Service fees may be charged according to the BVB price list for the re-issued Ticket, unless it is proven that the defect is the fault of BVB or a third party acting on BVB's behalf.

6.3 Loss: BVB is to be notified without undue delay via the Contact Address in text form (e-mail is sufficient) or by post of the loss of Tickets purchased from it. BVB is entitled to block these Tickets immediately after receiving such notification. In the event of the loss of a Ticket used to pass through the electronic barriers, the Ticket will be re-issued after the loss is reported, the Ticket is blocked and the customer's identity is confirmed. Service fees may be charged according to the BVB price list for re-issued Tickets. BVB files criminal complaints in the event of the system for reporting lost Tickets being misused. Other lost Tickets cannot be re-issued as a rule for security reasons.

7. Return and reimbursement; relocation

7.1 Right to withdrawal and return: Even though BVB offers Tickets via means of distance communication as defined in section 312c (2) of the German Civil Code (Bürgerliches Gesetzbuch, "BGB") and therefore a distance contract may be established according to section 312c (1) BGB, the customer has no right of withdrawal with the purchase of a Ticket pursuant to section 312g (2) no. 9 BGB. This means that there is no two-week right of withdrawal and return. Every submission of an offer or rather ordering of Tickets is therefore binding immediately after confirmation by BVB and obliges the customer to accept and pay for the ordered Tickets.

7.2 Swaps and returns: Tickets cannot be swapped or returned as a rule. If a customer is unable to use their Ticket for personal reasons (such as illness), they are permitted in these exceptional circumstances to transfer their Ticket to a third party in accordance with the terms of clause 8.3 (particularly using the official Secondary Market Platform of BVB).

7.3 Postponement, hosting at an alternative venue or abandonment: In the event of an event being postponed or hosted at an alternative venue, Tickets for the original event remain valid if the date and time of the original event had already been scheduled when the Tickets were purchased. The customer may withdraw from the contract. Notification of withdrawal must be submitted in text form (e-mail is sufficient) or by post to the Contact Address. The customer in question is reimbursed for the original Ticket price upon presentation of the Ticket or submission of the Ticket to BVB at the customer's expense, or, in the case of Tickets provided electronically, upon specifying the corresponding order number in the declaration of withdrawal; BVB reserves the right not to reimburse service and shipping fees. In the event of a match being abandoned, the customer is not entitled to the reimbursement of the original Ticket price unless the abandonment is the fault of BVB or, after weighing the customer's interests against those of BVB, the balance of interests in the specific case favours reimbursement. The final scheduling of an event is not deemed to constitute a postponement for purposes of this provision and does not entitle the customer to withdraw from the contract if the final date and time of the event had not yet been scheduled at the time the Ticket was purchased. BVB is not liable to the Ticket holder in such cases for non-recoverable expenses (such as travel or accommodation costs).

7.4 Replayed matches: In the event of a match that had already started and was then abandoned according to clause 7.3 being replayed, the replayed match is deemed to be a new event; the Ticket for the original event is not valid unless BVB expressly declares that such Tickets are also valid for the replayed match. If Tickets are valid for the replayed match, the customer is entitled to withdraw from the contract provided the Tickets are match Tickets. Notification of withdrawal must be submitted in text form (e-mail is sufficient) or by post to the Contact Address. The consequences of withdrawal as defined in clause 7.3 apply.

7.5 Cancellation and/or hosting behind closed doors: In the case of an event being cancelled without replacement or an event being ordered by a competent association or authority to be hosted either fully or partly behind closed doors, both BVB and the customer in question are entitled to withdraw from the contract concerning the purchase of Tickets for the event concerned. Notification of withdrawal from the customer in question must be submitted in text form (e-mail is sufficient) or by post to the Contact Address. The consequences of withdrawal as defined in clause 7.3 apply.

7.6 Non-recoverable expenses: In the cases set forth in clauses 7.3 to 7.5, BVB is not liable to the customer or Ticket holder for non-recoverable expenses (such as travel and accommodation costs) unless the event triggering the change in the contractual relationship is attributable to BVB or, after weighing the customer's interests against those of BVB, the balance of interests in the specific case favours reimbursement.

7.7 Relocation: The customer acknowledges that BVB is entitled, for a compelling reason (e.g. spectator restrictions imposed by associations, authorities or the law or other protective and safety measures), to re-allocate the customer to a different area of the Stadium in the same category or in a higher category; in this case, the customer is not entitled to withdraw from the contract or claim reimbursement.

8. Use and transfer; consequences of unauthorised transfer

8.1 Legitimate interests of BVB: It is in the interests of both BVB and customers and spectators to impose limits on the transfer of Tickets in order to prevent violence and criminal acts in the context of Stadium visits; to enforce stadium bans; to ensure the separation of opposing team fans; to prevent the unauthorised transfer of Tickets, especially Ticket touting (e.g. the purchase of Tickets with a view to selling them on directly or selling Tickets at elevated prices); and to ensure that as broad a range of fans as possible have access to Tickets at socially acceptable prices.

8.2 Unauthorised transfer: The sale of Tickets or issuing of Special Tickets takes place exclusively for the purpose of private and non-commercial use on the part of the customer; customers are prohibited from engaging in any further sale for commercial reasons as well as any otherwise unauthorised transfer or offering of Tickets. Unauthorised and therefore prohibited transfer or offering of Tickets is deemed in particular to include the following:

a) Offering Tickets for sale or transfer and/or selling and/or transferring Tickets publicly, particularly in auctions or online (for example using eBay, classified advertisements, Facebook) and/or on sales platforms not authorised by BVB (such as viagogo, StubHub, etc.), also expressly in the case of Tickets offered, sold or transferred without generating a profit or rather not at elevated prices.

b) Transferring Tickets at a higher price than was originally paid in accordance with the valid price list of BVB; a price increase of up to 10% is permitted to compensate for any transaction costs that are incurred.

c) Transferring Tickets on a regular basis and/or in large number, either for a single match day or over multiple match days.

d) Selling or transferring Tickets to commercial resellers and/or ticket agents.

e) Using or allowing the use of Tickets for commercial purposes without the express written consent of BVB, in particular for advertising or marketing purposes or as a bonus, gift, prize or part of an unauthorised hospitality or travel package.

f) Transferring Tickets to persons issued with a stadium ban, who have been banned from attending sporting events for security reasons in the past five years, particularly on account of engaging in football violence, or who have been issued with a stadium ban in this period, on the condition that the customer was aware or ought to have been aware of these circumstances.

g) Transferring Tickets to fans of the visiting club, on the condition that the customer was aware or ought to have been aware of these circumstances.

h) Reselling Special Tickets or transferring them to persons who do not fulfil the purpose associated with the Special Ticket.

i) Reselling Tickets if these Tickets were purchased using automated systems designed to circumvent restrictions on the number of Tickets able to be purchased by a single person (see clause 2.4) or other terms and conditions applying to the sale of Tickets (using what are known as bots).

j) Reselling or transferring to other persons Tickets that have had the personalisation printed on or stored in them (e.g. name, seat number, barcode, QR code, serial and/or shopping basket number) manipulated, made unrecognisable, changed and/or damaged.

8.3 Authorised transfer: Private transfer of a Ticket for non-commercial reasons, particularly in cases of illness or if the customer is otherwise unable to attend, is permitted if no instance of unauthorised transfer as defined in clause 8.2 applies and:

a) the transfer takes place using the Secondary Market Platform and in the manner required by the Secondary Market Platform in accordance with clause 8.4, or

b) provided that (1) the new Ticket holder accepts the application of these Terms and Conditions between them and BVB through the purchase and use of the Ticket, (2) BVB is, at its own request (e.g. due to protective and health and safety measures imposed by associations, by authorities or by law), informed of the transfer of the Ticket and the identity of the new Ticket holder or BVB has implicitly agreed to the transfer to the new Ticket holder and (3) the customer or recipient of the Ticket declares, at the request of BVB or the Organiser, whether Tickets were sold or transferred, when they were sold or transferred, how many were sold or transferred, at what price they were sold or transferred (if applicable) and to whom they were sold or transferred.

8.4 Secondary Market Platform: BVB may, at its own discretion, grant the customer the opportunity to offer a purchased Ticket for the specified match for resale to a potential secondary market buyer via the Secondary Market Platform at https://www.ticket-onlineshop.com/ols/bvb/ in accordance with the provisions below.

a) Prior to placing the Ticket for resale on the Secondary Market Platform, the customer must register online on the Secondary Market Platform. BVB reserves the right to refuse to place Tickets on the Secondary Market Platform in justified cases. Season ticket holders are entitled to offer their Right to Attend the respective match for resale as a match Ticket. Offering a Ticket does not automatically lead to the Ticket successfully being resold on the Secondary Market Platform.

b) As soon as a customer has placed a Ticket on the Secondary Market Platform for resale, they undertake not to assert their rights under this Ticket (e.g. sale, transfer, access to the event) for the duration of the offer. The customer is liable for any loss or damage resulting from the failure to comply with these terms and conditions. BVB also reserves the right to impose the sanctions listed in clause 8.6 against the customer or Ticket holder in question.

c) BVB informs the customer as soon as the Ticket has been successfully sold on the Secondary Market Platform. The contractual partner of the person purchasing the ticket on the secondary market is BVB, not the original customer. Clause 2.2 applies accordingly Ticket orders of the person purchasing the ticket on the Secondary Market Platform. From this point onwards, the offer made by the customer is final and the customer loses the Right to Attend granted by their Ticket. The customer is credited by BVB with an amount equal to the original price of the corresponding Ticket (or share thereof), plus service, operating and shipping costs incurred by BVB.

8.5 Data of the new Ticket holder: The name, address, e-mail address and telephone number of the new Ticket number is processed by BVB for the performance of the contracts between them and BVB and them and the customer in accordance with Article 6(1) sentence 1(b) GDPR as well as on the basis of BVB's legitimate interest in accordance with Article 6(1) sentence 1(f) GDPR. The legitimate interest of BVB arises from clauses 8.1 and 8.2.

8.6 Consequences of unauthorised transfer: In the event of one or more violations of the provisions set forth in clause 8.2 and/or any other unauthorised transfer of Tickets, BVB has a claim for prohibitory injunction due to the risk of repeat actions. BVB is also entitled:

 a) to not deliver to the customer or cancel Tickets that were used in contravention of the provisions in clause 8.2 prior to being provided or sent to the customer

b) to block and cancel the Tickets in question without compensation and deny the Ticket holder entry to the Stadium without compensation or rather eject them from the Stadium

c) to ban the customer from purchasing Tickets for an appropriate period of time, which may not exceed five (5) years, with the length of this ban depending on the number of violations, the number of offered, sold, transferred or used Tickets and the proceeds generated from resale

d) to cancel other Tickets purchased by the customer in question from BVB, including for similar events; to not deliver these Tickets to the customer in question; and to cancel them without compensation

e) to request from the customer the payment of the proceeds or profits generated from the unauthorised transfer of Tickets pursuant to clauses 8.2 a), 8.2 b), ), 8.2 d) and/or 8.2 j) in accordance with the terms of clause 14

f) to impose a contractual penalty against the customer in accordance with clause 11

g) to no longer grant the customer in question preferential rights, such as those associated with membership of BVB or of official fan clubs of BVB, and/or terminate the customer in question's membership of BVB

h) to report in an appropriate manner on the incident, on the basis of BVB's legitimate interest in accordance with clause 18.1, pursuant to Article 6 (1) sentence 1(f) GDPR – including by providing information relating to the customer – in order to prevent the unauthorised use of Tickets in the future

i) to pass on the personal details of the Ticket purchaser (name, address, e-mail address and telephone) to other Bundesliga clubs or rather cross-check these details in order to identify and prevent any further commercial resale and otherwise unauthorised transfer or offering of Tickets by the Ticket purchaser. This data is processed on the basis of BVB's legitimate interest in accordance with Article 6(1) sentence 1(f) GDPR.

 The legitimate interest of BVB arises from clauses 8.1 and 8.2.

9. Entry to and conduct in the Stadium

9.1 Stadium rules: Entry to the Stadium is subject to the Stadium rules displayed there and accessible at any time at https://www.bvb.de/Tickets/Infos-AGBs/Stadionordnung. By entering the Stadium site, Ticket holders accept the Stadium rules as binding on them; they apply irrespective of the validity of these Terms and Conditions.

9.2 Domiciliary right: BVB and any third parties acting on BVB's behalf are entitled to exercise their domiciliary right (Hausrecht) at any time. Instructions issued by BVB, the police, security personnel and Stadium management prior to, during and immediately after an event are to be followed at all times.

9.3 Right of entry: As a rule, every customer or Ticket customer with a validly acquired Right to Attend as defined in clause 2.5 is entitled to enter the Stadium. The Stadium rules, and particularly the instructions of the police, the Organiser and/or security personnel, are to be followed. Entry to the Stadium can be denied in the following cases:

a) If the customer or Ticket holder refuses to consent to appropriate checks conducted by security personnel of their identity and/or the items they are carrying with them prior to entering the Stadium site and/or the interior of the Stadium. Persons who bring items into the Stadium without permission and/or elude the checks conducted by security personnel may be ejected from the Stadium site or issued with a stadium ban pursuant to clause 11.11. BVB reserves the right to nominate special checkpoints or entry gates for certain items that are to be brought into the Stadium. Any items belonging to spectators that are confiscated by and/or handed over to security personnel are subject to the displayed terms and conditions.

b) If the customer or Ticket holder refuses to comply with the special attendance regulations as well as hygiene and infection prevention regulations in accordance with the Stadium rules.

c) If the customer or Ticket holder enters the Stadium site and leaves it again during the same event; in this case, the Ticket loses its validity.

d) If the personalisation printed on or stored in the Tickets (e.g. name, seat number, barcode, QR code, serial and/or shopping basket number) has been manipulated, made unrecognisable, changed and/or damaged or the Ticket has already been used to attempt to enter the Stadium, provided this is not the fault of BVB. In the case of justified denial of entry to the Stadium, the customer or Ticket holder has no entitlement to compensation.

e) If technical issues clearly attributable to the Ticket holder (e.g. malfunctioning smartphone, illegible print-out, etc.) result in electronic barriers not being able to be used.

9.4 Special terms and conditions of entry: BVB is entitled (and may be obliged), for a compelling reason, such as protective and safety measures imposed by associations, by authorities or by law, to impose special terms and conditions of entry for the purchasing of Tickets and presence in the Stadium and enforce compliance with these terms and conditions vis-à-vis the customer or Ticket holder.

a) BVB is entitled to apply certain requirements as a condition of Ticket purchase and presence in the Stadium, request proof of compliance with these requirements by the Ticket holder prior to Stadium entry as a condition of entry and review compliance with the defined requirements.

b) BVB is entitled to make Ticket purchase or presence in the Stadium conditional on additional terms, conditions or requirements (e.g. processing of additional personal data and/or processing of existing personal data for other purposes; only granting entry to the Stadium at particular times; compliance with certain health and safety standards). These terms, conditions or requirements will be made available to the customer in due time and are to be complied with by all Ticket holders. To the extent that such additional terms, conditions and requirements include the processing of other personal data and/or existing personal data for other purposes, BVB will inform the customer or Ticket holder pursuant to Article 13(f) GDPR in due time in advance regarding the specific scope and purpose of the data processing. 

The legal basis for the associated processing of personal data in each case is Article 6 GDPR.

c) If the customer or Ticket holder is not able to meet the special terms and conditions of entry pursuant to clause 9.4(a) and (b), BVB may deny the purchase of Tickets or entry to the Stadium. There is no right of recourse against BVB in this case.

d) If BVB only declares the special terms and conditions of entry pursuant to clause 9.4(a) and (b) to the customer after the purchase of the corresponding Tickets by the customer, the customer may withdraw from the contract – partially in the case of season tickets – with respect to the event concerned. The consequences of withdrawal as defined in clause 5.3 apply. There is no right of withdrawal if the special terms and conditions of entry pursuant to clause 9.4 (a) and (b) were already declared in a general sense when the Ticket was purchased. This right also lapses at the latest when the customer enters the Stadium site. There is no right of recourse on the part of the Ticket holder in this case.

9.5 Duty to inform and risk of infection: All Ticket holders are obliged to inform themselves of possible postponements, spectator exclusions and applicable protective and health and safety requirements. Up-to-date information on this matter can be found at https://www.bvb.de/Tickets/FAQ-AGBs/FAQ. Ticket holders also acknowledge that they may become infected with (viral) illnesses while attending an event, despite protective and health and safety measures being taken. Ticket holders consciously take on this risk in attending an event.

9.6 Assigned seating and standing room: Ticket holders must take up the assigned seat or standing room space indicated on their Ticket or rather for which their Ticket is valid. However, Ticket holders are obliged, at the request of BVB or security personnel to move to another seat or standing room space if necessary for a compelling reason (e.g. safety); Ticket holders have no right to compensation in this case.

9.7 Obstructed view: Spectators' view may be obstructed temporarily throughout the Stadium, particularly by the waving of flags and/or standing spectators. Complaints or claims for damages on the basis of such obstructions are excluded.

9.8 Fan blocks: The entire south terrace (S/W, Süd, S/O) as well as other blocks are allocated to fans of BVB ("Home Section"). In this Home Section and in other areas of the Stadium, views may be obstructed, particularly due to the waving of flags. Complaints or claims for damages on the basis of such obstructions are excluded. Due to the fact that BVB is obliged to separate fans from opposing teams for safety reasons, fans of the visiting club or persons who may be regarded as fans of the visiting club on account of their conduct or appearance ("Away Fans") are not permitted to enter or remain in the Home Section; entry to blocks exclusively used by the visiting club (Nord, N/O) is also not permitted in BVB colours. BVB, the police and security personnel are permitted to deny Away Fans entry to the Home Section, even if they are in possession of a valid Ticket, and/or eject Away Fans from the Home Section and, if there is enough capacity, accompany them or instruct a third party to accompany them to the Away Section of the Stadium. If no other suitable location can be found, the person in question may be ejected from the Stadium and/or denied entry to the Stadium, in which case the person in question has no claim to compensation.

9.9 Improper behaviour: Ticket holders are obliged to behave in a manner that does not impair and/or threaten the legal interests of BVB or any other persons present at events in the Stadium. In particular, provocative behaviour that may be likely to trigger a confrontation with other spectators or other persons present at events in the Stadium is prohibited. The rules of conduct set forth in this clause 9.9 are also intended to prevent tangible and intangible damage to BVB and/or visiting club due to the imposing of penalties by football associations due to the failure to control Home Fans and/or Away Fans.

In the case of one or more violations by Ticket holders or rather customers of the following rules of conduct, which apply to the entire Stadium and, when not explicitly limited to the Stadium area, also to travel/trips to and from BVB events organised by BVB, BVB, the police and/or security personnel are entitled:

  • to confiscate prohibited items carried by Ticket holders or rather customers without compensation and/or
  • deny Ticket holders or customers entry to the Stadium area and/or event location without compensation and/or to eject them from the Stadium or rather the site.

a) It is prohibited to enter the field of play without permission and/or climb or pass through the barrier fence or enclosure of the Stadium interior.

b) It is prohibited to be clearly under the influence of alcohol or drugs and/or wear a face covering, act violently or otherwise disrupt public order or arouse concerns about such conduct.

c) It is prohibited to carry and/or use the following items: weapons, items that may be used as weapons or projectiles, caustic or mildly flammable substances, bottles containing any material, cans or other containers made from fragile, splintering or especially hard material, torches, fireworks, smoke bombs and/or powder, flares and all other pyrotechnic objects and materials or components, laser pointers, bulky items, beverages not purchased in the Stadium, illegal drugs, clothing that could clearly be used as a face mask, animals and other items that could endanger or unreasonably interfere with safety in and around the Stadium, other spectators, players and/or officials.

d) It is prohibited to carry and/or use the following items: racist, xenophobic and/or right-wing or left-wing extremist propaganda materials, political or religious items of all kinds, including banners, signs, symbols and flyers, where there are grounds to assume that such items will be inappropriately displayed in the Stadium. Irrespective of items carried in the Stadium, expressing or disseminating hate speech or racist, xenophobic, politically extreme, obscene, provocative, insulting and/or far-left or far-right slogans or engaging in such actions is prohibited throughout the entire Stadium area.

e) Presence in the Stadium for purposes of compiling media reports about the event (TV, radio, internet, print, photo) and/or the collection of match data is only permissible with the consent of BVB and in the areas specifically designated for these purposes. Sounds, photos and/or images, descriptions or results or data regarding the event may not be recorded or collected without BVB's consent unless this is done solely for private and non-commercial use. Any commercial use, irrespective of in what manner and by whom, requires the written consent of BVB. In any event, it is prohibited to transmit images, audio and/or video recordings live or time delayed and/or to communicate such to the public online, in particular on social media platforms and/or apps, and/or other media (including mobile devices such as smartphones, tablets, etc.) and/or to support other people in the performance of such activities without the consent of BVB. Devices or systems whose intended purpose is to be used for such activities may not be brought into the Stadium without the consent of BVB or a third party authorised by BVB. BVB expressly advises that, in the event of a breach of these provisions, the DFL Deutsche Fußball Liga GmbH ("DFL GmbH"), Deutsche Fußball Bund e.V. ("DFB") and/or die Union of European Football Associations ("UEFA") are entitled to delete, or instruct a third party to delete, recordings that have been transmitted and/or publicly communicated.

Collecting, recording, transmitting, producing and/or distributing information or data concerning the match (e.g. match data or position data), style of play or other factors (whether using electronic devices or otherwise for commercial purposes (in particular for gambling)) is expressly prohibited in the Stadium.

Devices or systems whose intended purpose is to be used for such activities may not be brought into the Stadium without the express consent of BVB. In the event of a violation of these provisions, Ticket holders may be denied entry to the Stadium or be ejected from the Stadium.

BVB further notes that DFL GmbH, the DFB and/or UEFA may be entitled, in their own name, to assert any further claims accruing to BVB against the spectator in or out of court.

f) Acts that may evoke a direct or indirect commercial association with BVB, DFL Deutsche Fußball Liga e.V. ("DFL e.V."), DFL GmbH, the DFB, UEFA, the event or parts thereof, are prohibited throughout the entire Stadium area without the written consent of BVB or third parties authorised by BVB. In particular, in the Stadium area it is prohibited:

(i) to create or attempt to create such an association in another way through the unauthorised use of logos or other insignia

(ii) to engage in targeted commercial advertising of any kind, e.g. to distribute advertising brochures or other written information relating to a business, a product or a service,

(iii) to offer or sell food, drink, souvenirs, clothing or other items or services or to be in possession of such with the intent of selling them

g) The foregoing provisions notwithstanding, the following items may only be carried anywhere in the Stadium area with the consent of BVB: flag and banner poles that are more than 1.5 m long and/or have a diameter larger than 3 cm, two-pole banners, message banners, banners, flags and pennants with a surface area of more than 2 m2, mechanically or electrically operated noisemakers and/or devices for amplifying noise and/or speech.

h) It is also prohibited (i) to manipulate, make unrecognisable, falsify and/or damage the personalisation printed on or stored in the Tickets (e.g. name, seat number, barcode, QR code, serial and/or shopping basket number), (ii) be present in areas of the Stadium other than those indicated on the Ticket or the accreditation (circumventing block assignment) (iii) record, store, publish and/or publicly disclose in the entire Stadium area photographs, videos, images, or similar materials without the consent of the spectator (iv) unroll banners obscuring the view in the Stadium with the purpose of concealing or enabling prohibited actions.

Reference is otherwise made to the stadium rules with regard to the further details of bans and sanctions (see clause 9 (1) of these Terms and Conditions).

9.10 Video surveillance: To ensure and optimise Stadium security and to support the work of the regulatory authorities and police, the Stadium and some of the Stadium surroundings are under video surveillance pursuant to Article 6(1) sentence 1(f) GDPR in conjunction with section 4 of the German Federal Data Protection Act (Bundesdatenschutzgesetz, "BDSG"). Additionally, on match days the regulatory authorities and police use video surveillance equipment under their own responsibility to avert risks and pursue crime in accordance with the prevailing statutory provisions in the Federal Republic of Germany. Any recordings made by way of video surveillance will be treated confidentially by BVB or the regulatory authorities and police, but may be used as evidence in particular in cases where criminal offences are suspected and/or have been committed. The same applies as regards the specific respective visual and audio-visual recordings made pursuant to clause 10 that BVB or respective competent association under clause 10.3 transmits to public authorities or courts for these purposes in the event of a request to that effect pursuant to Article 6(1) sentence 1(c) or (f) GDPR. Recordings of events that pass without incident that are captured by the video surveillance system will be deleted in accordance with the data protection legislation applicable in the Federal Republic of Germany, in particular the GDPR and BDSG.

9.11 Sanctioning of prohibited conduct: In the event of violations of the provisions in clauses 9.6 and 9.9 and/or the special terms and conditions of entry pursuant to clause 9.4, acts defined in sections 3 and 27 of the German Assembly Act (Versammlungsgesetz, "VersG"), involvement in criminal acts relating to major event or public gathering (anlassbezogene Straftaten) and/or violence inside or outside of the Stadium, BVB may, in addition to the direct actions referred to in clause 9.9, impose the sanctions listed in clause 8.6 and/or clause 6.3 on customers or rather Ticket holders.

9.12 Stadium bans: In the event of violations of the provisions in clause 9.9, acts defined in sections 3 and 27 VersG, involvement in criminal acts relating to major event or public gathering and/or violence inside or outside of the Stadium, a limited stadium ban applying to the Stadium and, in particularly serious cases, a nationwide stadium ban may be imposed in addition to the direct actions referred to in clause 9.9 and the sanctions laid out in clause 9.11, further criminal and civil consequences notwithstanding. The DFB guidelines for the uniform enforcement of stadium bans, as amended, apply in this regard (https://www.dfb.de/verbandsservice/pinnwand/stadionverbots-richtlinien/). Recipients of stadium bans will be notified in writing. The processing of personal data in connection with stadium bans always takes place in accordance with the laws and regulations of the Federal Republic of Germany, in particular the GDPR and BDSG. BVB reserves the right to transfer the data of customers to the DFB for the purposes of stadium ban enforcement pursuant to Article 6(1) sentence 1(e) GDPR if necessary to ensure public order and safety in the Stadium.

9.13 Recourse: Violations of individual spectators or groups of spectators against the provisions in clause 9.9, in particular the use of flares and other pyrotechnic objects and/or the throwing of objects and/or unauthorised entry onto the field of play can result in BVB – and, in the case of corresponding violations by Away Fans, also the visiting club – being fined or issued with other sanctions by the competent associations (DFL GmbH, DFL e.V., DFB, UEFA). BVB or rather the visiting club is entitled to take full legal recourse against the individuals clearly identified as being responsible for said violations and assert claims for damages resulting from the sanction in accordance with rulings of the highest court. If multiple individuals are responsible, these individuals are deemed joint and several debtors within the meaning of section 421 BGB. This means that BVB or the visiting club may assert claims for damages against a single clearly identifiable individual with regard to the entire loss suffered by BVB or the visiting club as a result of the sanction if there is a causal link between the contributions to the offence of all of the persons responsible for it.

In addition, the Organiser reserves the right to deny persons who violate these terms entry to the Stadium without reimbursement of the price of the Ticket, to eject them from the Stadium, to exclude them from future Ticket purchases, to issue them with stadium bans, to transfer their stored data to other organisers and/or pursue further civil and/or criminal actions against them.

10. Recordings by event spectators

10.1 Recordings by spectators at events: BVB and the competent association under clause 10.3 or third parties instructed or otherwise authorised by them (e.g. radio, press) may, pursuant to Article 6(1) sentence 1(f) GDPR, produce visual and audio-visual recordings independently of one another which may show the Ticket holder as a spectator of the event in question for purposes of reporting the event and the competition to the public and for promotional purposes. BVB and the competent association pursuant to clause 10.3 and their respective affiliated companies pursuant to section 15 of the German Stock Corporation Act (Aktiengesetz, "AktG") as well as any third parties authorised by them (e.g., radio, press) pursuant to Article 6(1) sentence 1(f) GDPR may process and exploit these video and audio-visual recordings and communicate them to the public.

10.2 Purchasing Tickets for others: If a customer purchases Tickets not just for themselves but also for others (Ticket holders), the customer must ensure that the information set out in this clause 10 and clause 15 is communicated to the Ticket holder in question; this does not affect the terms governing authorised transfer set out in clauses 8.2 and 8.3.

10.3 Competent association: The following associations are responsible for the organisation of the sporting competitions in which BVB participates:

a) Bundesliga and Bundesliga 2: DFL e.V., having its registered office in Guiollettstraße 44-46, 60325 Frankfurt am Main, Germany, the operating business of which is managed by DFL GmbH, having its registered office in Guiollettstraße 44-46, 60325 Frankfurt am Main, Germany;

b) DFB Cup: DFB, having its registered office at the DFB-Campus, Kennedyallee 274, 60528 Frankfurt am Main; and

c) UEFA Champions League, UEFA Europa League and UEFA Conference League: UEFA having its registered office in Route de Genève 46, 1260 Nyon, Switzerland. 

11. Contractual penalty

11.1 Prerequisites: In the event of a culpable breach on the part of the customer of these Terms and Conditions, particularly in the case of one or more terms set forth in clause 10.2 – especially clause 10.2(a) and (b) – or clause 9.6, BVB is entitled, in addition to the other possible actions and sanctions under these Terms and Conditions and notwithstanding any further claims for damages (including any legal recourse pursuant to clause 9.11 or rather tort law provisions) to impose an appropriate contractual penalty in the amount of EUR 2,500.00 against the customer for each individual instance of breach.

11.2 Amount: The amount of the contractual penalty primarily depends on the number and severity of the breach, the nature and degree of fault (wilful or negligent conduct), efforts and success on the part of the customer or Ticket holder to repair the damage, whether or not the customer or Ticket holder is a repeat offender and, in the case of unauthorised resale of Tickets, the number of offered, sold, transferred or used Tickets and the proceeds or profits generated from resale. The contractual penalty may exceed the profits or profits generated from resale.

12. Transfer of proceeds

12.1 Prerequisites: In the event of the unauthorised transfer of Tickets by the customer pursuant to clause 8.2 a) and/or clause 8.2 b), BVB is entitled to impose a contractual penalty in accordance with clause 11 and, in addition to the possible actions and/or sanctions defined under these Terms and Conditions, receive from the customer the proceeds or profits generated from the unauthorised transfer of Tickets either in full or in part.

12.2 Amount and use: The criteria referred to in clause 11.2 are used to determine whether and to what extent the proceeds are required to be transferred. BVB will donate the transferred proceeds or profits to charitable causes (such as to support youth football and/or the "Leuchte auf" foundation.

13. Liability

Persons present at or in the Stadium are there at their own risk. This applies in particular with respect to any infection with the Covid-19 virus or any comparable infections. BVB, its legal representatives and/or its vicarious agents are only liable for damages in connection with these Terms and Conditions and the presence of the Ticket holder at and in the Stadium, regardless of the legal basis, in the case of wilful conduct or gross negligence or in the event of material contractual obligations – in the case of the latter limited to loss or damage that was foreseeable at the conclusion of the contract and in its nature is typical of the contract. Material contractual obligations are those that enable the proper performance of the contract, the violation of which jeopardises the purpose of the contract and the upholding of which the customer can rely upon. This limitation of liability does not apply to claims for damages based on injury to life, limb or health or other bases of strict statutory liability.

Reference is made in relation to any consumer disputes to clause 16.5 of the Terms and Conditions.

15. Data protection

Unless otherwise expressly stated in these Terms and Conditions (such as in clause 9.4 with regard to special terms and conditions of entry, 9.10 with regard to video surveillance and 10 with regard to recordings by event spectators), the processing of the personal data of the customer and/or the Ticket holder takes place for the performance of a contract between BVB and the customer/Ticket holder or rather between the customer and the Ticket holder pursuant to Article 6(1) sentence 1(b) GDPR. The personal data of the customer and/or the Ticket holder is otherwise processed to safeguard the legitimate interests of BVB. The legitimate interests arise from clause 8.1. Additional data protection regulations, including the rights of the Ticket holder under the GDPR and the contact details for the BVB data protection officer can be found in the Privacy Policy available at www.bvb.de/Tickets/Infos-AGBs/datenschutz. With regard to the creation and publication of visual and audio-visual recordings of BVB events (see clause 10), additional reference is made to the privacy policies of the respective competent associations, the DFL e.V. at https://www.dfl.de/de/datenschutz/, the DFB at https://www.dfb.de/datenschutzerklaerung/ and UEFA at https://www.uefa.com/privacypolicy/.

16. Choice of law, place of performance, jurisdiction

16.1 Choice of law: The compulsory legal provisions of the country in which the customer is habitually resident apply. German law applies in all other respects. The United Nations Convention on the International Sale of Goods (CISG) does not apply.

16.2 Place of performance: The registered office of BVB is the sole place of performance for supply, performance and payment.

16.3 Jurisdiction: The place of jurisdiction for all disputes arising out of or in connection with these Terms and Conditions and/or their validity or legal transactions on the basis of these Terms and Conditions is the registered office of BVB, unless the customer is a consumer.

16.4 Language: In the event of differences in interpretation of the German version of these Terms and Conditions and any English translation, the German version takes precedence.

16.5 EU dispute settlement/resolution pursuant to the German Act on Alternative Dispute Resolution in Consumer Matters (Verbraucherstreitbeilegungsgesetz, "VSBG"): The EU offers an online platform customers can use to settle consumer disputes out of court: http://ec.europa.eu/consumers/odr/.

BVB does not participate in dispute resolution procedures before a consumer conciliation body (see section 36 VSBG).

17. Additions and amendments to the ongoing legal relationship

Even in the case of ongoing contractual relationships with customers, BVB is entitled to supplement and/or amend these Terms and Conditions to an extent that is reasonable to the customer in the event of changes in the market situation and/or legislation and/or rulings issued by the highest court, including in the case of existing (continuing) contractual obligations.

All amendments will be notified to the customer in writing or – with the customer's consent – online (e.g. via e-mail). The additions and/or amendments are deemed to have been accepted if the customer does not object in writing or online in the specified manner (e.g. via e-mail) within a period of four weeks after receiving notice of the additions and/or amendments, provided BVB expressly referred to this implied acceptance in its notice. If the customer objects to the additions and/or amendments, BVB is entitled to terminate the legal relationship for good cause.

18. Severability

Should any provision of these Terms and Conditions be invalid either in full or in part, this does not affect the validity of the remaining provisions or remaining parts of such provisions. In the event of an invalid provision, the parties shall agree in good faith to replace it with a provision that most closely reflects the economic intent of the invalid provision. The same applies to any omissions in these Terms and Conditions.
